Your dedicated Data Protection Officer (DPO) and EU representative for the purposes of the GDPR

Under the EU General Data Protection Regulation (GDPR), non-EU companies that offer goods or services to individuals in the EU—or monitor their behavior—are legally required to appoint an EU-based Representative under Article 27 GDPR.

In many cases, companies must also designate a Data Protection Officer (DPO) under Article 37, particularly if they process large-scale personal data, sensitive data, or engage in systematic monitoring.

Failing to comply can result in regulatory investigations, blocked data transfers, reputational damage, and fines of up to €20 million or 4% of global turnover.

How VIAX Language and Legal Supports You

We act as your EU Representative and/or DPO, ensuring that you meet all GDPR obligations while staying focused on your business operations.

1. Acting as Your EU Representative (GDPR Article 27)

If your company is based in China and processes data of individuals in the EU, GDPR requires you to appoint a designated Representative located within the European Union.

As your official GDPR Representative, VIAX Language and Legal will:

    • Serve as the official contact point for European data protection authorities (DPAs) and data subjects
    • Maintain a Record of Processing Activities (ROPA) on your behalf, as required by Article 30 GDPR
  • Support you in case of DPA investigations, complaints, or access requests
  • Ensure your privacy documentation is GDPR-compliant and accessible in the EU
  • Assist with cross-border data transfer strategies, including SCCs or Transfer Impact Assessments

We help businesses establish criteria for identifying high-risk clients based on factors like the client’s background, business activities, and geographic location.

For high-risk clients, we assist in implementing enhanced verification procedures, such as obtaining additional documentation, verifying the source of funds, and conducting ongoing monitoring of client activity.

If suspicious activity is identified during due diligence, businesses must report this to the appropriate authorities. We ensure that your company is equipped to meet its reporting obligations and minimize exposure to financial crime risks.

2. Acting as Your Data Protection Officer (GDPR Article 37)

If your Chinese company conducts large-scale or sensitive data processing involving EU individuals, GDPR may require you to appoint an independent Data Protection Officer (DPO).

VIAX Language and Legal offers outsourced DPO services that are both legally compliant and operationally effective.

Our DPO services include:

  • Monitoring your GDPR compliance across business functions
  • Advising your internal team on data protection obligations and best practices
  • Conducting Data Protection Impact Assessments (DPIAs) for high-risk processing
  • Overseeing your incident response and data breach notification procedures
  • Acting as your liaison with EU supervisory authorities
  • Guiding your team in privacy-by-design implementation

Our outsourced DPO model ensures independence, neutrality, and cost-efficiency, especially for Chinese companies that do not wish to hire a full-time EU-based officer.
