Why Product Safety Compliance Matters in the EU

The EU General Product Safety Regulation (GPSR – Regulation (EU) 2023/988) applies from 13 December 2024 and sets legally binding requirements for all consumer products placed on the EU market—including those manufactured outside the EU.

For Chinese companies exporting to Europe, non-compliance can result in:

  • Blocked shipments at customs
  • Product delisting or withdrawal from the market
  • Fines, penalties, and reputational damage
  • Mandatory product recalls and loss of buyer confidence

To avoid these outcomes, Chinese manufacturers must meet strict obligations relating to safety documentation, labeling, incident reporting, traceability, and appointment of a legally accountable EU-based Responsible Person (RP) (offered separately).

What the GPSR Requires

Under the GPSR, manufacturers placing consumer products on the EU market must:

  • Conduct and maintain a documented risk assessment for each product category
  • Provide safety instructions and warnings in all relevant EU languages
  • Ensure product traceability via batch numbers, serial codes, or scannable labels
  • Report serious product-related safety incidents to EU authorities within 2 working days
  • Appoint an EU-based Responsible Person before placing the product on the EU market

How We Support Your Compliance

At VIAX Language and Legal, we provide legal structuring and documentation services that help Chinese companies meet GPSR obligations with clarity, precision, and confidence.

We do not offer product testing or technical file drafting — instead, we focus on creating a legally sound compliance framework backed by enforceable documentation and clear internal procedures.

We help businesses establish criteria for identifying high-risk clients based on factors like the client’s background, business activities, and geographic location.

For high-risk clients, we assist in implementing enhanced verification procedures, such as obtaining additional documentation, verifying the source of funds, and conducting ongoing monitoring of client activity.

If suspicious activity is identified during due diligence, businesses must report this to the appropriate authorities. We ensure that your company is equipped to meet its reporting obligations and minimize exposure to financial crime risks.

2. OEM/ODM & Product Supply Agreement Review

If you manufacture products under OEM or ODM arrangements, or distribute through EU agents, your contracts must reflect the new regulatory landscape.

We offer:

  • Review and negotiation of OEM / ODM agreements with compliance obligations clearly allocated
  • Drafting of product supply contracts to ensure alignment with GPSR duties, enforcement exposure, and notification protocols
  • Guidance on shared liability clauses, escalation procedures, and cooperation during recalls or investigations
